CLEVELAND - Two Ohio voters, including Domino's pizza worker Christopher Barkley , claimed yesterday that they were hounded by the community-activist group ACORN to register to vote several times, even though they made it clear they'd already signed up.

Barkley estimated he'd registered to vote "10 to 15" times after canvassers for ACORN, whose political wing has endorsed Barack Obama, relentlessly pursued him and others.

Claims such as his have sparked election officials to probe ACORN.

"I kept getting approached by folks who asked me to register," Barkley said. "They'd ask me if I was registered. I'd say yes, and they'd ask me to do it [register] again.

"Some of them were getting paid to collect names. That was their sob story, and I bought it," he said.

Barkley is one of at least three people who have been subpoenaed by the Cuyahoga County Board of Elections as part of a wider inquiry into possible voter fraud by ACORN. The group seeks to register low-income voters, who skew overwhelmingly Democratic.

"You can tell them you're registered as many times as you want - they do not care," said Lateala Goins, 21, who was subpoenaed.

"They will follow you to the buses, they will follow you home, it does not matter," she told The Post.

She added that she never put down an address on any of the registration forms, just her name.

A third subpoenaed voter, Freddie Johnson, 19, filled out registration cards 72 times over 18 months, officials said.

"It feeds the public perception that there could be [fraud], and that makes the pillars fall down," said local Board of Elections President Jeff Hastings.

Registering under a fake name is illegal. But officials usually catch multiple registrations and toss them.

The major risk of fraud growing out of mass canvassing involves the possibility of ineligible voters filing absentee ballots, and thus avoiding checks at polling places, said Republican National Committee chief counsel Sean Cairncross.

The subpoenas come as Republicans have ramped up criticism of ACORN. Officials in Nevada raided ACORN's Las Vegas office Tuesday, accusing the group of signing people up multiple times - in some cases under phony names, like those of Dallas Cowboys.

ACORN's Cleveland spokesman, Kris Harsh, said his group collected 100,000 voter-registration cards; only about 50 were questionable, he claimed.

As for workers, "We watch them like a hawk," he said.

Lawmaker's son indicted in Palin e-mail hacking

WASHINGTON - A federal grand jury has indicted the son of a Democratic Tennessee state lawmaker in connection with the hacking of the e-mail account of Republican vice presidential candidate Sarah Palin.

David Kernell, 20, of Knoxville, Tenn., the son of state Rep. Mike Kernell, was scheduled to be arraigned Wednesday before U.S. Magistrate Judge C. Clifford Shirley, according to a statement from the Justice Department.

David Kernell was indicted Tuesday by a federal grand jury in Knoxville for intentionally accessing without authorization the e-mail account of Palin, Alaska's governor, the Justice Department said.

Kernell, an economics major at the University of Tennessee in Knoxville, faces a maximum of five years in prison, a $250,000 fine and a three-year term of supervised release.

His father, a Memphis Democrat, is chairman of Tennessee's House Government Operations Committee. Mike Kernell has said he had nothing to do with the hacking incident.

The indictment against David Kernell alleged that on Sept. 16 he reset the password to Palin's personal e-mail account to gain access to it. Authorities say Kernell then read the contents of the account and made screenshots of the e-mail directory, e-mail content and other personal information, later posting some of the information to a public Web site.

The Justice Department said the case was being prosecuted by section chief Michael DuBose and trial attorney Mark Krotoski of the criminal division's computer crime and intellectual property section and Assistant U.S. Attorney Greg Weddle of the U.S. Attorney's Office for the Eastern District of Tennessee. The FBI's Anchorage and Knoxville field offices investigated the case.

Hunt for Palin hacker shaping up to be simple case

WASHINGTON - The hunt for the hacker who broke into Republican vice presidential candidate Sarah Palin's personal e-mail account is shaping up to be a remarkably simple investigation, by the standards of major cybersecurity whodunits.

U.S. investigators figure the hacker claimed responsibility in a detailed accounting that included his own personal e-mail address and that he tried to cover his trail using a U.S. Internet anonymity service that has been surprisingly cooperative with the FBI in efforts to peel away that anonymity.

Not exactly the plot of a Hollywood thriller.

In what may be a significant break in the case, the FBI searched the residence of the son of a Democratic state lawmaker in Tennessee over the weekend looking for evidence linking the young man to the break-in, two law enforcement officials told The Associated Press. The apartment the FBI searched is in a complex about five blocks from the University of Tennessee campus, in a neighborhood popular with students.

David Kernell, 20, has not returned repeated phone calls or e-mails from the AP since last week. His lawyer said Monday the family is going through a difficult period. Kernell is an economics major at the University of Tennessee in Knoxville.

"The Kernell family wants to do the right thing, and they want what is best for their son," said attorney Wade V. Davies of Knoxville. "We are confident that the truth will emerge as we go through the process. David is a decent and intelligent young man, and I look forward to assisting him during this difficult period."

Kernell is the son of state Rep. Mike Kernell, a Memphis Democrat and chairman of Tennessee's House Government Operations Committee. The father declined last week to discuss the possibility his son might be involved in the case.

"I had nothing to do with it, I had no knowledge or anything," Mike Kernell told the AP last week.

"I was not a party to anything of this nature at all," he added. "I wasn't in on this — and I wouldn't know how to do anything like that."

No one answered the door at Mike Kernell's home in Memphis on Monday, and he did not return repeated phone calls Monday from the AP.

Palin's e-mail account with Yahoo Inc. was compromised last week by a hacker who revealed as evidence a few inconsequential personal messages she has received since John McCain selected her as his running mate. The McCain campaign confirmed the break-in and called it a "shocking invasion of the governor's privacy and a violation of law."

Palin used "gov.sarah" in one of her Yahoo e-mail addresses she sometimes uses to conduct state business. The hacker targeted her separate "gov.palin" account.

During the break-in, the hacker used an Internet address that traced to David Kernell's apartment complex in Knoxville. The FBI obtained logs Saturday establishing the connection from Gabriel Ramuglia of Athens, Ga., who operates an Internet anonymity service used by the hacker.

Ramuglia told the AP the FBI asked him to confirm that the address appeared in his records. Ramuglia said his logs showed the hacker visiting Yahoo's mail service, resetting Palin's password and announcing results of the break-in on a Web site where the hacking was first disclosed.

"I think he just didn't realize the severity of what he was doing until afterwards," Ramuglia said.

After the break-in, a person claiming responsibility published a detailed chronology of the hacking on the same Web site. That person identified his e-mail address as one that has been linked publicly to David Kernell.

Kernell's father, Mike Kernell, has a strait-laced reputation among his colleagues.

"Mike Kernell is your quintessential Boy Scout," said state Rep. John Deberry, another Democrat. "Mike follows the rules. He will almost get on your nerve as far as making sure things are done by the book."

"If Mike had known anything about this, he would have had a fit on his son," Deberry said. "When I saw his reaction when he first heard about it, the absolute fear and shock that was on his face, I realized then he had absolutely nothing to do with it."

Experts said the hacker apparently left an easy trail for investigators.

"He might as well have taken a picture of his house and uploaded it," said Ken Pfeil, an Internet security expert. "He should have just set up a big beacon that said, 'Here's my house,' or confessed. If they can't catch this guy based on all the information posted on the Web then all bets are off."

This one was all over the net yesterday. Apparently, a poster at the radical nutroot site, DemocraticUnderground, created a fake listing for someone pretending to sell baby Trig on ebay. The faux listing read “Baby used prop newborn boy 3-6 months special needs,” and included a description that called Governor Palin a “pushy social climber, unwilling to let pregnancy and children stand in the way of ambition.” It also listed baby’s Trig’s father as “unknown.”

Originally appearing on the DemocraticUnderground at around 1PM on September 4, by DU poster Bob Weaver, the thread was soon locked by DU moderators and the image scrubbed from the site. But not before a screen shot was taken…

Bernie Mac makes off-color joke at Obama event

- CHICAGO (AP) — Comedian Bernie Mac endured some heckling and a campaign rebuke during a surprise appearance Friday night at a fundraiser for Democratic presidential candidate Barack Obama.

Toward the end of a 10-minute standup routine at the Hyatt Regency Hotel in downtown Chicago, the 50-year-old star of "The Bernie Mac Show" joked about menopause, sexual infidelity and promiscuity, and used occasional crude language.

"My little nephew came to me and he said, 'Uncle, what's the difference between a hypothetical question and a realistic question?'" Mac said. "I said, I don't know, but I said, 'Go upstairs and ask your mother if she'd make love to the mailman for $50,000.'"

As the joke continued, the punchline evoked an angry response from at least one person in the audience, who said it was offensive to women.

"It's not funny. Let's get Barack on," a man shouted from the crowd, which paid $2,300 each to support the Illinois senator.

About 15 minutes later, Obama tried to smooth things over with a joke of his own.

"We can't afford to be divided by race. We can't afford to be divided by region or by class and we can't afford to be divided by gender, which by the way, that means, Bernie, you've got to clean up your act next time," Obama said. "This is a family affair. By the way, I'm just messing with you, man."

The incident drew response from Obama's campaign, which criticized Mac for his choice of material.

"Sen. Obama told Bernie Mac that he doesn't condone these statements and believes what was said was inappropriate," spokeswoman Jen Psaki said in a statement after the event.

Mac, a Chicago native, said he's a longtime Obama supporter and called the presumptive Democratic nominee a "man's man" while offering him advice for the duration of the campaign trail.

"People like rumors. They're going to say things like you was at the club with Lil' Kim, and you and Kanye West got into a fist fight," he said. "You can't get upset. You've got to keep hope alive."

Mac's appearance was Obama's first celebrity event of the evening. Later at a Lincoln Park nightclub, Obama spoke to a raucous crowd of music fans, who paid up to $500 per person to see a performance by Wilco lead singer Jeff Tweedy, and two other band members.

"Before these guys go, I want them to know that I had heard a rumor that they had suggested that I had nothing by them on my iPod," Obama said. "That is not true. I love Wilco."

Hit-and-run suspect is illegal immigrant, had DUI

A memorial marks the spot where 5-year-old Annabelle Sandoval died Sunday.

She was riding in a truck with her father and her three siblings when police say 27-year-old Wilson Alba-Cano pulled out in front of the family near 7th Avenue and Roeser in Phoenix.

According to police, Alba-Cano, an illegal immigrant who had been arrested before for DUI, was drunk at the time of the hit-and-run.

"It is very heartbreaking," said Gay Cox.

Gay and Tony Cox watched the family's truck flip four times.

"The father was trying to hustle three kids off to the side so they wouldn't get hit by any oncoming cars," Gay said.

"I was just hoping that it was not someone under the truck because you could tell it was a human being just like crying out," said hit-and-run witness Angel Guzman.

Guzman ran to help after witnessing the hit-and-run.

Annabelle was pinned under the truck. At least two of the children had been ejected. A 3-year-old broke his leg.

Witnesses rolled the overturned truck off its side.

"(They) just flipped it back over so it would get off that little girl," Tony Cox said.

Police say Alba-Cano drove off after hitting the truck and soon crashed into a front yard before fleeing.

Witnesses reportedly followed Alba-Cano and held him until police arrived and arrested him. He's charged with manslaughter.

Investigators tell us the children were not wearing seatbelts.

New Jersey 2nd-grader suspended from school for drawing stick figure firing gun

DENNIS TOWNSHIP, N.J. - A second-grader’s drawing of a stick figure shooting a gun earned him a one-day school suspension.

Kyle Walker, 7, was suspended last week for violating Dennis Township Primary School’s zero-tolerance policy on guns, the boy’s mother, Shirley McDevitt, told The Press of Atlantic City.

Kyle gave the picture to another child on the school bus, and that child’s parents complained about it to school officials, McDevitt said. Her son told her the drawing was of a water gun, she said.

A photocopy of the picture provided by McDevitt showed two stick figures with one pointing a crude-looking gun at the other, the newspaper said. What appeared to be the word "me" was written above the shooter, with another name scribbled above the other figure.

School officials declined to comment Friday. A message left at the superintendent’s office Saturday was not returned.

Kyle drew other pictures, including a skateboarder, King Tut, a ghost, a tree and a Cyclops, the newspaper reported.

It starts out as a stick figure gun before it evolves into violating the civil rights of undocumented immigrants, women, minorities, and other repressed groups. The solution here is intense sensitivity training and community service in which this white male can be shown the proper way to behave in today's society. The authorities should take action against the mother; possibly removing the child permanently from his unfortunate home situation.

Vote to Kill ‘Fairness Doctrine’ Forever Could Come up Today

n an effort to kill it forever, Representative Mike Pence (R-Ind.) is attempting to force a vote on the floor of the House today over the future of the so-called “Fairness Doctrine.” Pence already secured passage of the “Free Flow of Information Act” to protect the press and is now launching an effort to nix the ability of the executive branch from re-instituting the woefully unfair “Fairness Doctrine,” a relic from the 1980s that deserves to remain dead and buried.

Using a somewhat arcane House rule called a “discharge Petition,” Pence and Representative Greg Walden (R- Ore.) are attempting to defy the House majority and force a vote on the measure. A “discharge petition” would need the support of 218 members of the House to force a vote and Pence already has 201names pledged to support him. He needs only 17 Democrats to join the effort and Pence can defeat the efforts of Nancy Pelosi to block the attempt.

Here is your cue. If you are in a district that sent a Democrat to the House of Representatives, call him immediately and ask him to support Mike Pence’s measure. If he can get this measure passed, we can prevent a future Democrat president from re-instituting the “Fairness Doctrine” by using his power to appoint left leaning FCC commissioners who will be compliant enough to reinstate this failed doctrine of the past. If Pence is successful, we can at least stop this newest attempt by the left to secure left leaning media bias and quash conservative voices in the media.

As Robert Bluey of the Heritage Foundation wrote on his Bluey Blog today:

The return of the Fairness Doctrine would be dreadful for broadcasters, many of whom have conservative viewpoints, Pence told a group of conservative bloggers at the Heritage Foundation yesterday. He said many political commentators would quit rather than keep talking because of the paperwork and legal issues that are likely to result.

Not only that but what station owner would go to all the Herculean efforts to include all voices in the political spectrum every single broadcast? Surely station owners would just assume not have any political commentary at all rather than bend over backwards, lose money, and give their hosts short shrift to satisfy this backwards and oppressive FCC rule?

Bluey continues:

Pence, himself a former radio-show host, was confident yet realistic about his chances of finding the votes. “I don’t think freedom is a partisan issue in the House of Representatives,” he said. He noted that 113 Democrats voted for a similar measure this summer that prevented the FCC from restoring the Fairness Doctrine for one year. Making that ban permanent won’t be as easy.

Folks, we have a chance to kill this abomination against free speech. I urge you folks with Democrat Representatives to call your House member ASAP.

A Threat to the Internet

In our rapidly changing global marketplace, America's entrepreneurs, innovators, and workers are striving to remain competitive, and Republicans in Congress have consistently focused on keeping the Internet free from taxation, cutting taxes so entrepreneurs will have a greater incentive to put more money into growing their businesses, and removing regulatory obstacles to competition. The result has been an improving standard of living, millions of additional private sector jobs, and new products, services, and industries that enrich our lives every day.


Since taking the Majority in the U.S. House, by contrast, Democrats have promoted what they call their "Innovation Agenda." In reality, this agenda amounts to little more than a litany of recycled federal initiatives, proving once again that congressional Democrats believe the ideas which trigger innovation and economic growth come to life in Washington, D.C. and not in the free market.


Curiously missing from the Democrats' Innovation Agenda is a measure to make permanent the ban on Internet taxes. Their deafening silence on the issue is especially noteworthy because the ban - first put in place by a Republican Congress in 1998 - is set to expire in mere weeks, on November 1. Few people would argue with the fact that the Internet is driving economic growth in ways we couldn't have imagined 20 years ago. And, at the same time, few people fail to see its potential for driving new economic growth in the future. In fact, the Internet could be viewed as the "hub" of innovation in the 21st Century; there's simply no telling what new doors it could open for students, workers, and consumers in the future.


So, why would we even consider levying onerous taxes upon it? In my view, there's no quicker way to reverse the Internet's incredibly strong and positive impact on our economy than to force consumers and business owners to pay even more to access and make purchases over it.


But that's just what could happen if the ban ever expired: states and localities would have free-rein to tax the web. And that's why, on a number of occasions over the past decade, the Republican-led House passed legislation to make this ban permanent. Unfortunately, our efforts were consistently thwarted by the Senate, leading us to pass a temporary moratorium, which - as I noted - will expire in a matter of weeks. To keep Congress from having to punt on the tax ban once again, House Republican leaders have called on Speaker Nancy Pelosi (D-CA) and Majority Leader Steny Hoyer (D-MD) to follow the Republican House's lead and schedule a permanent Internet tax ban for a vote. To date, all they have done is advanced a temporary extension of the ban in the Judiciary Committee - ignoring our request to schedule a House vote on a permanent ban.


The Democratic leadership's refusal to schedule a vote on a permanent Internet tax ban is particularly puzzling given their afore-mentioned Innovation Agenda. One of the core goals of that agenda, for example, is the "nationwide deployment of high speed, always-on broadband Internet and mobile communications." A copy of the agenda - publicly available on Speaker Pelosi's website - affirms, "Just as railroads and highways did in the past, broadband and mobile communications will dramatically increase the productivity and efficiency of our economy in the future and bring more Americans into an online global community and marketplace."


I happen to agree. Yet I also happen to believe that the productivity and efficiency of our economy would be stalled significantly if Internet access and purchases were taxed. And that's precisely why the ban must be made permanent.


The Democrats' agenda further states, "Small businesses are the catalysts for technological innovation... Yet small businesses face significant hurdles, both regulatory and marketbased, that thwart the effort to transform ideas into jobs. Removing these hurdles is a key component of this Innovation Agenda."


Once again, I happen to agree. Yet I also happen to believe that taxing the Internet would be a severe blow to small business owners and their employees. But don't just take my word for it. Democratic Chairwoman of the House Small Business Committee, Rep. Nydia Velazquez (D-NY), recently acknowledged that the tax hike would saddle small businesses with a 15 to 30 percent increase in their Internet bills. Once again, that's precisely why the ban must be made permanent.


So why are Democratic leaders dragging their feet on legislation to protect small businesses and other Internet users from a massive tax hike? For the answer, one needs to look no further than the record they've assembled on taxes all year long. Democratic tax hike proposals so far this year include: the now-infamous $150 billion "war surtax" proposal; federal gas tax hikes to pay for Democratic energy legislation and infrastructure; and a massive $392.5 billion tax increase on middle-class families in their very first budget proposed in the Majority. And that's just the tip of the iceberg. Democrats also are preparing for battle over the alternative minimum tax - a particularly perverse tax swamping more and more middle-income families that Republicans want to eliminate and Democrats want to preserve.


Al Gore didn't create the Internet, but the leaders of his party have proven themselves eminently capable of taxing it. By refusing to make the Internet tax ban permanent, the Democratic leadership is playing an irresponsible game of chicken with American consumers and our nation's economy. As November 1 draws closer, Democrats face a choice: will they protect millions of consumers and small businesses from a massive, abrupt tax increase, or will they add to their ever-growing list of tax hikes and undermine the very same innovation they claim to be promoting on Capitol Hill?

Reid to miss Ford funeral

WASHINGTON - Incoming Senate Majority Leader Harry Reid will miss the state funeral for former President Gerald Ford at the Capitol Rotunda on Saturday night, opting instead to lead a delegation to South America with an expected stop at the Machu Picchu Inca ruins.

Reid, D-Nev., left Wednesday afternoon from Andrews Air Force Base in Maryland with a bipartisan group of five other senators, including Sen. Dick Durbin, D-Ill., the incoming assistant majority leader, for what has been described as a weeklong visit to Bolivia, Ecuador and Peru.

The highlight of the trip is said to be separate meetings with the presidents of the three nations, with the last one scheduled in Peru on Tuesday afternoon.

"They would be difficult to cancel," Reid spokesman Jim Manley said via mobile phone as the congressional delegation took off in a U.S. military plane.

The senators are also scheduled to be in Cuzco, Peru, on Sunday, which would give them an opportunity to view the nearby Inca ruins and anything else in advance of New Year's Eve.

Manley said the senators opted to skip Ford-related ceremonies over the next few days because of the long-scheduled meetings with the South American presidents, noting that U.S. relations with some of the countries are in need of improvement.

Manley did not rule out the possibility that the delegation might return to Washington for at least one Ford-related event, perhaps a church service Tuesday morning. But their meeting with Peru's president, scheduled for the afternoon, could interfere with that, he said.

"Senator Reid has tried to reach Mrs. Ford," Manley said, adding that the senator had not received a return call from her before the delegation had departed for South America. Manley later added that Reid had called the former first lady to express condolences, and also to explain why the delegation might not make it back to Washington for the funeral.

Durbin's office released a statement before he left, calling Ford, who died Tuesday at age 93, "a man of principle, integrity and honesty who helped heal the nation during some of our darkest times." He offered his "deepest condolences" to the Ford family.

Other senators making the trip are Kent Conrad, D-N.D., Judd Gregg, R-N.H., Robert Bennett, R-Utah, and Ken Salazar, D-Colo.

Why am I not surprised? Durbin and Reid are 2 first class schlemiels who dont deserve the offices they hold. Regardless of the difficulties in getting meetings scheduled with other Presidents, it would be understood if this entourage stayed behind and did the right thing in helping to honor a man who was our President.

Guaranteed they will be back to dance on Fords grave.

Pelosi may refuse to seat a certified Republican winner

Despite warnings that it could turn the new Congress into a partisan battleground, incoming House Speaker Nancy Pelosi refuses to rule out the possibility that Democrat Christine Jennings could be seated to represent the 13th District when the 110th Congress convenes in 12 days.

Republicans and even some Democrats said they expect the seat to go to Republican Vern Buchanan, the certified winner by 369 votes.

But Pelosi, who will head a 31-seat Democrat majority in the House, has refused to shut the door on Jennings, until audits, lawsuits and a House investigation are completed.

"The bottom line here is that nothing’s off the table," said Pelosi spokesman Drew Hammill.Buchanan, who claims the election was cleanly decided and criticizes Jennings for contesting the result, will be in Washington, D.C., next month, ready to assume the duties, aides say.

"Historical precedent is that when there’s a contested race the certified winner be seated," said Buchanan spokeswoman Sally Tibbetts. "Therefore, we fully expect Vern Buchanan to be seated on Jan. 4."

But Pelosi’s spokesman said calls for seating the certified victor represent a Republican interpretation, not an iron-clad rule.

In 1984, for example, a Democrat-controlled House refused to seat Republican Richard McIntyre, the certified winner by 418 votes after a state-ordered recount.The statement from Pelosi’s office comes two weeks after national Democratic Party Chairman Howard Dean said that Buchanan should "absolutely not" be seated on Jan. 4.

It is unclear, however, whether other Democrats — assuming control of the House for the first time in more than a decade — are ready for the battle that would ensue if Buchanan is denied the seat without a court ruling or other legal mandate.

"At most, he should be seated provisionally," said Congresswoman Debbie Wasserman Schultz, D-Pembroke Pines and one of Jennings’ closest allies. "In my mind, I can’t really justify leaving the constituents of the 13th District without representation during the House Administration and the court’s review."

So far, neither a state audit of the iVotronic touch-screen voting machines nor lawsuits by Jennings and voting groups have produced evidence to suggest Election Day malfunction.

This week, the contested election entered the political realm when Jennings took her challenge to Congress, filing a contest with the House Administration Committee seeking an investigation and, possibly, a new election.

Such challenges can take months or longer to resolve.

If Buchanan takes the seat on Jan. 4, history bodes well for his keeping it. Only two of the 105 contests filed since 1933 have resulted in an unseating, the last time in 1967, according to a committee report.

Unlike the audit and lawsuit, the outcome of Jennings’ U.S. House challenge could hinge on partisan politics.

In a prescient exchange five weeks before the Nov. 7 election, Democratic and Republican House leaders acknowledged gray areas in the law and politics of election challenges, foreshadowing the complicated and bruising path that could await Jennings.

On Sept. 28, Rep. Steny Hoyer, D-Md., wrote the Republican chairman of the House Administration Committee, Rep. Vernon Ehlers of Michigan, noting that he was "deeply concerned" about "ambiguities and deficiencies" of the election contest laws.

Hoyer, the incoming House majority leader, called the law "so ambiguous that it can actually exacerbate an inherently partisan process rather than tame it."

Two weeks after the letter, both sides met to discuss the questions Hoyer raised. Another letter followed from Ehlers on Nov. 3, agreeing that changes ought to be made and outlining a proposal. The exchange died there. On Wednesday, a spokeswoman for Hoyer called Ehlers’ letter and proposal a "non-response."

"We’re basically left with the law that covers these types of issues," said Hoyer spokeswoman Stacey Bernards.

Hoyer’s letter raises specific doubts about the committee’s power to subpoena evidence, which could be tested if Jennings’ attorneys fail to convince a state judge that the voting machine manufacturer should turn over the source code to the machine software.

Election Systems & Software Inc. has refused to do so, calling it a trade secret. Jennings’ experts hope to examine the code for flaws that might have contributed to the nearly 18,000 undervotes in the race.

Before the 1996 election contest, the committee’s subpoena power under the Federal Contested Election Act had gone untested, Hoyer wrote Ehlers. Some subpoenas in that case went unanswered for nearly a year.

"When the process was tested, it was found profoundly wanting," Hoyer wrote. "Neither the courts nor the committee has the power to enforce the subpoenas."

Karl Sandstrom, elections counsel to the committee from 1979 to 1992, described the House elections contest process as one replete with "mythmaking," "partisan power plays" and "dueling press conferences."

"The House’s procedures are not as spelled out as in a judicial contest," he said of contests brought under the Federal Contested Election Act. "People can easily start believing their own political spin, and the facts can easily be spun."

Hoyer’s letter echoes those concerns, ending on a dour note. "With the direction of the House likely to turn on a handful of seats, ensuring that contested elections are adjudicated in a fair, transparent, and swift manner is essential," Hoyer wrote. "If the last contested House election is any guide, FCEA many not be up to the challenge."

Once again this is a story that we will only read about in the local papers. Not in our mainstream media. Because it puts the lie to the Democrats’ talk of ending corruption and partisanship.

Of course the Democrats are just doing what they always do. Winning power by any means possible — fair or foul. Even if it means stealing an election outright.

Sadly, the Republicans will probably do what they always do — concede rather than put up a fight.

It’s all in a day’s work for Pelosi’s "most ethical Congress ever."
